When we went to the District Attorney's office, they had a child psychologist interview her to make sure that she was telling the truth. She was. They determined that they couldn't file formal charges either because a pen is not a weapon and he had not touched her anywhere else. He never admitted to doing it. He even said that he didn't even keep pens in his classroom. I was able to prove that was a lie, because of the time he had written the homework assignment on several children's hands with ink. He did receive a formal, permanent mark on his record.
